No-Fault Divorce

There is only one no-fault ground for divorce in South Carolina. In order to file for a no-fault divorce, you and your spouse must live in separate homes at the time of filing and must then "live separate and apart continuously for one year" to get the divorce. A separation agreement is often reached during that year, which we can assist you in drafting to address important issues.
Grounds for Fault-Based Divorce
Many marriages end because of a specific reason. South Carolina allows for fault-based divorce on the grounds of adultery, habitual drunkenness or drug abuse, physical violence or threats, and desertion.
If one of these grounds applies to your situation, you can file for divorce on the basis of fault.
